US DOT Announces Updated Civil Penalties
As we enter a new year filled with rapid advancements and innovations across various industries, it is a stark reminder of the critical role hazardous materials regulations play in maintaining transportation safety within the global supply chain.
In line with the start of 2025, the US Department of Transportation has released updated civil monetary penalties for violations of the 49 CFR hazardous materials regulations. These penalties are adjusted annually to account for economic inflation, ensuring their continued effectiveness as a deterrent.
Effective December 30, 2024, the adjusted penalties, as published in 49 CFR §107.329, are as follows:
- Violation of hazardous materials transportation law: Up to $102,348
- Violation resulting in death, serious illness, severe injury, or substantial property destruction: Up to $238,809
- Minimum penalty for violations related to training: $617
The full rulemaking, which contains all updated penalties, can be read in its entirety at this link: Federal Register / Vol. 89, No. 249 / Monday, December 30, 2024 / Rules and Regulations
These amounts should serve as a sobering reminder of the gravity with which hazardous materials regulations are established, monitored, and enforced. They also underscore the crucial role each of us plays in maintaining daily compliance.
